These Terms of Service ("Terms") govern your access to and use of the website located at sommersoft.io and any associated subdomains (collectively, the "Site"), operated by Sommersoft, LLC, an Indiana limited liability company ("Sommersoft", "we", "us", or "our").

All content on this Site — including text, graphics, logos, images, icons, and software — is the property of Sommersoft, LLC or its content suppliers and is protected by United States and international intellectual property laws.

The Sommersoft name, logo, and tagline "Indy Built For Tomorrow" are trademarks of Sommersoft, LLC. You may not use them without our prior written consent.

You are granted a limited, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use only. Nothing on the Site transfers any intellectual property rights to you.

04 Products & Services

This Site is currently an informational and pre-launch presence. The products and services described on the Site — including CloudOps for Restaurants, AI Workflow Automation, Managed Cloud Hosting, Business Intelligence Suite, Custom Software Development, and Local Business AI Concierge — are in development and not yet commercially available.

Descriptions of planned features, pricing, availability, and timelines are subject to change at any time without notice. Sommersoft makes no commitment that any described product or feature will be released in the form described, on any particular timeline, or at all.

Subscription to our mailing list does not constitute a purchase, reservation, or guarantee of access to any future product or service.

05 Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. Sommersoft does not warrant that:

• The Site will be uninterrupted, timely, secure, or error-free.
• The results obtained from use of the Site will be accurate or reliable.
• Any errors in the Site will be corrected.

To the fullest extent permitted by applicable law, Sommersoft expressly disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

These Terms are governed by and construed in accordance with the laws of the State of Indiana, United States of America, without regard to its conflict-of-law provisions.

Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Marion County, Indiana. You consent to personal jurisdiction in those courts.
